Terms of Use

These Terms of Use (hereafter — the "Terms") govern your use of:

• the Aquarama mobile and web Application (hereafter — the "Application");
• the website aquarama.vercel.app (hereafter — the "Site");
• the marketing website aquarama.ge;
• the services provided through these resources by Aquatec Systems Georgia LLC (hereafter — "Aquarama", "we", "our").

By registering or using the Application or the Site you confirm that:

• you are at least 16 years old (minors — with parental consent);
• you have read and agree to these Terms;
• you have read and agree to the Privacy Policy.

If you do not agree with any provision — please do not use our service.

Aquarama is a car wash in Batumi (Georgia) and the related application that allows you to:

• create an account and view your car wash visit history;
• keep a deposit to pay for services;
• receive notifications when your car is ready;
• invite friends and earn bonuses through the referral program.

Car wash services are provided physically at the car wash premises. The Application is a supporting tool for user convenience.

4.1. Creating an account

To register you need to provide:

• a working mobile phone number (to receive SMS codes);
• first and last name (optional, but simplifies identification with the operator).

Registration is confirmed by a one-time SMS code (OTP).

4.2. One account — one person

Each account is bound to a single phone number. Creating multiple accounts on multiple numbers by the same person for the purpose of repeatedly receiving referral program bonuses is prohibited and may lead to blocking of all linked accounts.

4.3. Security

You are responsible for keeping your one-time login codes confidential. Do not share them with third parties. If you suspect your account has been compromised — notify us immediately.

4.4. Accuracy of data

You undertake to provide accurate information. Using someone else's phone number or false data — we reserve the right to block the account without refunding the deposit balance.

5.1. Service pricing

Aquarama sets and may change the prices of car wash services. Current prices are displayed at the car wash premises and communicated by the operator before work begins.

5.2. Payment methods

• cash at the counter;
• bank card via POS terminal;
• bank transfer;
• from the deposit in the Application.

5.3. Deposit

The deposit is money you pre-load on your account that is automatically spent when paying for services. Key points:

• the deposit can be topped up at the car wash premises or through the Application;
• top-ups of ≥1000 ₾ receive a bonus (details — on the Site and in the Application);
• the deposit is not refundable in cash but can be used in full to pay for car wash services;
• the deposit has no expiry while the account is active;
• if the account is inactive for more than 3 years — the remaining deposit may be cancelled after SMS notification.

5.4. Referral program bonus

When a friend invited by you visits our car wash for the first time:

• 10 ₾ bonus is added to your deposit (the amount may change, the current value is shown in the Application);
• your friend gets a 20% discount on their first visit (applied automatically).

5.5. Refunds

Refunds of paid amounts are possible only in case of:

• material defects in services provided (by agreement with the manager);
• technical errors in debiting from the deposit.

A refund request must be sent to info@aquarama.ge within 14 days. Full details — see the Refund and Cancellation Policy.

6.1. License

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes in accordance with these Terms.

6.2. Prohibited

• using the Application for illegal purposes;
• attempting unauthorized access to servers, databases or other users' accounts;
• distributing malicious software;
• decompiling, modifying or creating derivative works from the Application;
• using the Application on behalf of another person without their consent;
• mass-creating fake invitations to receive bonuses;
• placing offensive, illegal or misleading content in name, notes and similar fields.

6.3. Consequences of violations

In case of violation of the Terms we reserve the right to:

• temporarily or permanently block the account;
• cancel accumulated bonuses and the deposit;
• report the violation to law enforcement (in case of illegal actions).

7.1. How it works

1. A registered user invites a friend by providing their phone number.
2. An SMS with the Application link and a discount code is sent to the specified number.
3. If the friend registers and visits the car wash within 30 days — 10 ₾ is credited to the inviter's deposit, and the friend automatically receives a 20% discount on their first visit.

7.2. Participation conditions

• the program is available only to registered users;
• you may only invite people who have agreed to receive SMS from Aquarama (see Privacy Policy, section 12);
• a phone number can only be invited once globally;
• self-invitation (to your own number) is prohibited;
• you may only invite new customers — if the number is already registered, the invitation does not count.

7.3. Invitation validity period

An invitation is valid for 30 calendar days from the moment of sending. If the friend does not arrive within this period — the invitation is cancelled, no bonus is credited.

7.4. Specific bonus and discount amounts

The bonus (default 10 ₾) and discount (default 20%) amounts may be changed by the administration. The current values are shown in the Application at the moment the invitation is created. Changes apply only to new invitations.

7.5. Abuse

Mass invitations to random numbers, use of virtual number services, collusion with other users to obtain bonuses — all such actions are violations and lead to account blocking and cancellation of accumulated bonuses.

All rights to the Application, the Site, the "Aquarama" logo, design, texts, code and database belong to Aquatec Systems Georgia LLC.

You do not receive any intellectual property rights, except for the limited license to use the Application for personal purposes (see section 6.1).

Content you add in the Application (name, notes, information about your car) remains your property, but you grant us a limited license to store and process it for the purposes of providing services.

9.1. Application "as is"

The Application and the Site are provided on an "as is" and "as available" basis. We do not warrant:

• uninterrupted operation of the Application;
• the absence of errors and bugs;
• compatibility with all devices and operating systems;
• data accuracy at every point in time.

9.2. Limitation of liability

To the maximum extent permitted by law, our aggregate liability to you shall not exceed the amount you have paid for car wash services in the last 12 months. We are not responsible for:

• indirect damages (lost profits, moral damages);
• actions of third parties (banks, communications providers, SMS providers);
• inability to use the Application due to causes beyond our control.

9.3. Car wash services

Car wash services are provided physically. We are responsible for service quality under the ordinary rules of the Georgian Consumer Rights Protection legislation. Claims are accepted immediately after the service is provided — the operator will record them in the system.

10.1. Termination at your initiative

You can delete your account at any time through the Application's "Profile" menu or by sending a request to info@aquarama.ge. After deletion:

• access to the Application is terminated immediately;
• data is deleted as described in the Privacy Policy;
• accumulated bonuses and the deposit are cancelled.

10.2. Termination at our initiative

We reserve the right to terminate your access in case of violation of the Terms, suspicion of fraudulent actions, or account inactivity for more than 3 years. We will notify you by SMS or email at least 7 days in advance (except in cases of serious violations requiring immediate action).

We may change these Terms from time to time. We will notify you of material changes in the Application, by email or SMS, no later than 30 days before the changes take effect. Continued use of the Application after the changes take effect means your acceptance of the new terms.

These Terms are governed by the laws of Georgia. All disputes not resolved by negotiation are subject to consideration in the courts of general jurisdiction at Aquarama's location (Batumi, Adjara). Before going to court, please contact us directly — most issues are resolved within a few hours without formal procedures.
